Trine D. Martinez, who has pleaded not guilty, is charged with fatally shooting Earl W. Wyatt III, 44, of Fairfield, and Damion Davis, 36, of Suisun City, and wounding a third man in Fairfield.

"Close enough works for horseshoes and hand grenades, but it doesn't work for indictments," Anthony Gann's attorney argued.
